A EVOLUÇÃO DOS CONTRATOS DE GESTÃO NAS ESTATAIS BRASILEIRAS: DO MODELO FEDERAL À IMPLEMENTAÇÃO NO PIAUÍ
Abstract
This article examines the normative and institutional evolution of management contracts in Brazil, focusing on their nature, purposes, and legal implications for state-owned enterprises in the process of transitioning from dependency to economic and financial sustainability. Based on the analysis of the Federal Constitution, Law No. 13,934/2019, and Federal Decrees No. 12,302/2024 and No. 12,500/2025, it is observed that the management contract has been consolidated as an instrument of governance and accountability, linked to sustainability plans and the establishment of objective performance goals. The study also addresses the case of the State of Piauí, particularly the Companhia Porto Piauí, highlighting the legal feasibility of replicating the federal model at the state level. It concludes that the adoption of management contracts may foster greater efficiency, transparency, and rational allocation of public resources, thereby strengthening the fiscal and institutional balance of Piauí’s state-owned enterprises.
