This article aims to analyze the position of the Spanish Jesuit Quirício Caxa in his debate with Manuel da Nóbrega. Initially, we will discuss some of the main interpretations of the debate and show how they attribute to Caxa a supposedly voluntarist position regarding rights, making him a representative of a modern and individualistic conception of rights. After presenting our disagreements with respect to the interpretations mentioned, we will seek, in the second part, to recover the textual sources mobilized by Caxa. The central objective is to present the author who, in debating one of the main problems of the colonial world, mobilizes traditional theological and juridical sources in favor of his thesis.
