Abstract

Brazilian fossils are known worldwide, especially those from the Araripe Sedimentary Basin. The Federal Constitution of 1988 considers fossils as cultural heritage, but the absence of specific legislation makes their protection difficult. Fossils as goods
cultures deserve to be protected and safeguarded in scientific collections of public research institutions, such as universities and museums; they deserve a prominent place and must be accessible to society. This work presents a discussion about the legal support that the
paleontological heritage has in Brazil. And it shows the need to create legal provisions that guarantee their custody, combat trafficking and express punishments and sanctions for those who squander the paleontological heritage.

Paulo Victor de Oliveira, Universidade Federal do Piauí

Graduated in Biological Sciences from the Vale do Acaraú State University - UVA (2007). Master in Geosciences, by the Institute of Geosciences, Federal University of Rio Grande do Sul - UFRGS, with concentration area Paleontology (2010). PhD in Geosciences, Department of Geology, Federal University of Pernambuco - UFPE, with concentration area Sedimentary and Environmental Geology (2014). Class C Professor, Adjunct, Level 003, at the Federal University of Piauí, assigned to the Biological Sciences course at the Senador Helvídio Nunes de Barros Campus, in Picos-PI. Permanent Professor of the Graduate Program in Geology at the Federal University of Ceará. Collaborating Researcher at the UVA Paleontology Laboratory and Dom José Museum, in Sobral-CE. Collaborating Researcher at the Ozildo Albano Museum, in Picos-PI. He has experience in the field of Geosciences, Paleontology, Comparative Anatomy (osteology), Zoology (mastozoology and paleomastozoology); Sedimentary Basins of Ubajara, Parnaíba and Araripe; Quaternary, tank and cave deposits, ichnofossils, paleontological heritage and scientific dissemination. President of the Research Nucleus in Natural Sciences in the Semi-Arid Region of Piauí (NUPECINAS). Academic of the Bachelor's Degree in Law at the State University of Piauí, Campus Prof. Barros Araújo, Picos, Piauí.

Maria Somália Sales Viana, Universidade Estadual Vale do Acaraú

Graduated in Geology from the Federal University of Ceará (1985), Master in Geology from the Federal University of Rio de Janeiro (1990), PhD in Geosciences from the Federal University of Rio Grande do Sul (1999) and Post-Doctorate on Paleontological Heritage at the Federal District of Rio de Janeiro (2018). She was a professor of Paleontology at the Federal University of Pernambuco from 1992 to 2003. She is currently an adjunct professor ix at the Universidade Estadual Vale do Acaraú-UVA. Has experience in the field of Geosciences, with emphasis on Taphonomy of Vertebrates, working mainly on the following subjects: education; paleontological heritage; Araripe and Parnaíba sedimentary basins; fossils, northeastern paleontology, and tank and cave deposits. He is an effective member of the Brazilian Society of Paleontology and leader of a research group; belongs to the faculty of the Graduate Program in Geology at the Federal University of Ceará, supervising a doctoral thesis. She is the Coordinator of the UVA Paleontology Laboratory and works in research and extension activities with the Dom Museum.
